7:00pm Waters Farm Yearly Update
Present: Ken Kelley, Pennie Linder Putnam, Pam Farnham Gurney, Norma Bedrosian.
K. Kelley explained to the Commission that they were here to meet the lease requirements for the second year. Mr. Kelley read his report and presented the report to the Commission along with the $10.00 fee.
M. Briggs opened the meeting at 7:05pm for the Lease Agreement review.
K. Kelley introduced all the Waters Farm members present. He reviewed the past 2008 events and reported on the activities of the farm. He presented the Conservation Commission with a booklet of all items requested for the yearly lease agreement for this second years lease.
M. Briggs asked for a copy of the Bylaw that is currently being revised, when it becomes available.

Mr. Windle did not come in front of the Commission. He was sent a registered letter to appear at this meeting. The Commission opted to issue a daily ticket for $300.00 until the erosion control area was stabilized.

The continuation was opened at 7:30pm. M. Briggs read the hearing notice as it appeared in the Millbury Sutton Chronicle.
The purpose of this hearing is to review a Notice of Intent submitted to the Conservation Commission by Linda Erickson, M.D. Realty Trust, Lincoln, NH. The project consists of repairs to the existing retaining wall at Ramshorn Pond, and repairs to existing house and septic system outside the 100í buffer zone.
Present: Norman Hill, Land Planning, for Robert Murphy, Murphy Associates, and Linda Erickson, M. D. Realty Trust, the owner, also present was Steve Camole, Contractor.
N. Hill reviewed the information from the last meeting and stated they are meeting with ZBA on April 2nd to ask for a variance on the side lines. They would like to repair the existing stone retention wall and fill in behind the wall to raise it on the up hill side and excavate below the wall for the footings.

M. Briggs said the Board needs a better definition on the grade, fill and final grade of the landing area, which needs to be on the plans along with a planting plan.
J. Sheehan questioned the existing contour of the wall and suggested shrubs be put on top of the north wall area.
M. Briggs questioned the roof runoff and infiltration, and stated the items listed below need to be on the plans: Definition of grades towards the house, planting plan with the list of native species, roof runoff on the shed and house, fertilizer on lawn is 20-0-10 (zero phosphate), additional erosion control, and permit information from both ZBA and BOH.

Motion: To issue an Order of Conditions subject to the applicant providing a proper grading for
the plateau, planting plan, the shrubs on the wall, measures for roof runoff, stipulation
for 20-0-10 fertilizer, and additional erosion control measures during construction.
Also subject to the applicant acquiring the permitting from the ZBA and BOH. No
work permitted by this Order may begin unless and until the applicant receives a
subsurface sewage disposal permit from the Sutton Board of Health which complies
with both the requirements of Title V and any more stringent local standards, and until a
copy of said permit is sent to the Conservation Commission. J. Sheehan

The continuation was opened at 7:50pm. M. Briggs read the hearing notice as it appeared in the Millbury Sutton Chronicle.
The project consists of site work without a house, driveway and landscaping in the buffer zone, no work within the resource areas.
Present: Robert Murphy, Murphy Associates, Ron Samuelson, owner, Chris Butler, contractor
R. Murphy explained that the existing house was a hazard per the building department. The house is now gone and there are some areas that are stabilized with gravel, loam, and seed. Behind the evergreens there is a stream that passes under the road. The haybale dyke that is there now was put in during the demolition of the house that was taken down. There is no work to be done in the buffer zone except the installation of the driveway. Additional haybales would be put beyond the existing haybales during excavation. They are proposing a replanting plan on the slope.
R. Samuelson explained where the excavator was sitting there was a 25í hole left from the previous owner, that they were filling in with the excavator, per order of the building inspector along with the demolition of the house that had burned.
R. Murphy said they are proposing to stabilize the plantings and to locate a driveway in the buffer zone which is about 90í away from the wetlands, and to put the driveway in an area best suited based upon the topography.

R. Samuelson explained the cesspool would be pumped and filled, compacted and buried.
M. Briggs said to replace the haybales with Canadian hay or a silt sock, and show the limit of the clearing to be the limit of work, on the plans.
The Board will do a site visit on March 21, 2009 at 9:00am.

The project consists of an addition, new foundation, and attached garage with driveway for and existing single-family house in the buffer zone of a BVW and Lake Singletary.

The project consists of requesting an Order of Conditions for the newly revised operations and maintenance plan for the Manchaug Reservoir.
Present: Don Cooper, Attorney for Manchaug Reservoir Corporation, Attorney Gallagher, Wendy Porter, Interface Global
D. Cooper gave a letter and summary, from the Manchaug Reservoir Corporation, to the Board for peer review. He stated under MGL 10.05 5B1 this hearing that was continued from March 4, 2009. The Conservation Commission did not have authority to continue without the applicantís permission, matters can be discussed tonight, but cannot be accepted.
J. Sheehan stated the Commission had no steps as regards to peer review. DEP, and the Fisheries have been sent copies and the Conservation Commission must make a decision by March 24, 2009.
The March 4th meeting was continued for the Commission to have an opportunity to have a peer review.
D. Cooper stated the applicant was not willing to enter into a peer review.

BOARD BUSINESS
The Board signed an Order of Conditions for 107 Boston Road/Hair Inc., but did not sign the Extended Order of Conditions for Lackey Dam Estates. The contractor will receive a letter to come before the Board for further discussion, as to why the extension is needed.
The Board was reminded about the Conservation Restriction workshop on April 8, 2009 at 7:30pm. Information was mailed out on March 9th to all Chapter 61, 61A & 61B landowners for this workshop.
